This survey course will cover general insurance law concepts as well as the real world application of these concepts. Students will be expected to complete all external reading and research prior to class so they are prepared to participate in hands on application exercises during class time. We will be reviewing insurance contracts, state v. federal preemption issues, pending state and federal legislation, insolvency concepts and complex fraud/enforcement concepts.
A great deal of the course time will be spent on the federal Health Care Reform and how this series of laws will be interpreted and enacted in the fifty states, what this means for future state/federal preemption conflicts, and what can be the expected jurisdictional outcomes and conflicts that will occur in bringing administrative enforcement and criminal actions.
